In many states, people will choose to go through mediation when they are having child custody disputes.  In fact, in a few states, mediation is a pre-requisite for child custody proceedings.  In the state of Arizona, parents do not have to go through mediation, but they may request private custody evaluations. 

What is a Private Custody Evaluation?

A private custody evaluation occurs when there are conflicts or issues of contention between two parents regarding the custody of their children.  During an evaluation, a neutral third party, such as a lawyer, will listen to both parents.  The third party will carefully document what each parent has to say about the situation.  The evaluator may also choose to interview the child and take into account the child’s preference.  Evaluations are conducted to get a better sense of what type of living and legal situation would best suit the child in question.

Once the evaluation is completed, the evaluator will report his/her findings to a family court.  He/she will recommend which parent the child should live with or suggest the ideal custody situation for the child.  In most cases, the court will listen to the evaluator’s judgment and rule according to the evaluator’s recommendations.

When people decide to go through a private custody evaluation, they will be responsible for finding a neutral, unbiased evaluator.  A private evaluator is not appointed by the court and he/she may be a counselor, child psychologist or even a family lawyer.  Due to the fact that the evaluator will play a huge role in the outcome of all child custody proceedings, it is imperative that parents secure the services of a qualified professional who has the experience and knowledge it takes to conduct a fair analysis.
